1. Acceptance of Terms

By creating an account or using MyFitFix, you confirm that:

• You are at least 13 years of age (or the minimum age required in your jurisdiction)
• You have the legal capacity to enter into a binding agreement
• You will comply with all applicable laws and regulations
• All information you provide is accurate and up-to-date

2. Use of the Service

2.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the MyFitFix application for personal, non-commercial purposes in accordance with these Terms.

2.2 Account Registration

To access certain features of the Service, you may need to create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

2.3 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Transmit viruses, malware, or other harmful code
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Scrape, mine, or collect user data without authorization
• Reverse engineer, decompile, or disassemble the application
• Remove or modify any proprietary notices or labels

4. Subscription and Payment

4.1 Subscription Plans

MyFitFix may offer free and premium subscription plans. Premium features require a paid subscription, which may be billed monthly, annually, or on other terms as specified at the time of purchase.

4.2 Billing

• Subscriptions automatically renew unless canceled before the renewal date
• You authorize us to charge your payment method for all fees incurred
• Prices are subject to change with advance notice
• All fees are non-refundable except as required by law

4.3 Cancellation

You may cancel your subscription at any time through your account settings or the app store. Cancellation will take effect at the end of your current billing period.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Quest Developers LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

6. User Content

6.1 Your Content

You retain ownership of any content you submit, post, or upload to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content solely to provide and improve the Service.

6.2 Content Standards

User Content must not:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Contain offensive, harmful, or inappropriate material
• Promote violence, discrimination, or illegal activities

6.3 Content Removal

We reserve the right to remove or disable access to any User Content that violates these Terms or is otherwise objectionable, without prior notice.

7. Privacy and Data

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of content

We do not guarantee that the Service will meet your requirements or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUEST DEVELOPERS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Personal injury or property damage
• Business interruption
• Any other damages arising from your use of or inability to use the Service

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to liability, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Quest Developers LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if:

• You violate these Terms
• We are required to do so by law
• We discontinue the Service

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will:

• Notify you via email or in-app notification
• Update the "Last updated" date at the top of this page
• Provide at least 30 days' notice before changes take effect

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyFitFix regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
